When you apply for a job, your prospective employer may use a consumer report to evaluate you as a potential employee. A consumer report is a collection of documents that may include credit reports, criminal and other public records such as bankruptcy filings, and records of civil court procedures and judgments. Increasingly, these records also include your activity on social media, such as Twitter and Facebook.

Who Provides Consumer Reports

The companies that provide consumer reports, what is in them and who may obtain them are all regulated by the Federal Trade Commission in compliance with the Fair Credit Reporting Act.

The primary sources for consumer financial information are the three large credit reporting agencies: Experian, TransUnion and Equifax. These credit reporting agencies give employers detailed information about your personal credit activity, including consumer debt and payment activity as well as adverse information, such as bankruptcies and late payments. Your credit report also includes adverse tax payment information at federal, state and county levels. Sometimes the report includes an overall credit score – often called a FICO score – provided by the Fair Isaac Corporation.

In addition to the credit bureaus, other agencies provide consumer data. Companies like Intelius and ID Analytics provide background information that includes criminal records, civil judgments and some public records. Employers often research your social media activity themselves, but a growing number of companies such as SproutSocial.com research and analyze your social media activity and provide a potential employer with an analysis.

Who May Obtain Your Consumer Report

The general public has limited access to consumer reports, especially your credit report. Under the Fair Credit Reporting Act, a prospective employer has a right to obtain these records, but only with your written permission. Normally, when you fill out and sign an employment application you grant the employer that right.

If your application for employment is turned down, you have a right to see the consumer report your prospective employer obtained. You also have a right to a free credit report from the credit reporting agency used by that employer. By law, you can access your credit report from all three credit bureaus annually.

What to Do if Your Consumer Report Is Wrong

When your consumer report contains inaccuracies, the Federal Consumer Financial Protection Agency recommends contacting both the agency that provided the wrong information and the company source for that information in writing to notify both companies of the mistake and to request a correction.
