What are the rules for government contractor gifts? ›

o Gifts: • Gifts from contractors and other prohibited sources are generally limited to non-cash items worth $20 or less. Gifts from subordinates are generally limited to non-cash items worth $10 or less.

$590 Gift Limit (Effective January 1, 2023 - December 31, 2024): State and local officials and employees are prohibited from receiving a gift or gifts totaling more than $590 in a calendar year from certain sources.

You may accept a gift given under circ*mstances that make it clear that the gift is motivated by a family relationship or personal friendship rather than your official position.

Filing Form 709: First, the IRS primarily finds out about gifts if you report them using Form 709. As a requirement, gifts exceeding $15,000 must be reported on this form.

Annual Exclusion for Gifts. The annual exclusion from gift tax (i.e. the amount that may be gifted annually to individuals without tax consequence) has increased from $17,000 to $18,000 per recipient for 2024.

Both types of gifts share three elements which must be met in order for the gift to be legally effective: donative intent (the intention of the donor to give the gift to the donee), the delivery of the gift to the donee, and the acceptance of the gift.

Reporting Gifts

While employees may not accept gifts from prohibited sources or gifts given because of their official positions, there are exceptions, for example where individual items are valued at less than $20 per occasion and a total of $50 from one source in a calendar year.

As a general rule, Government employees may not accept gifts, including gifts of travel, if the gifts is from a prohibited source or given because of the employee's official position. There are, however, a number of exclusions and exceptions to the general prohibition that may permit acceptance of such a gift.
