- If a Settlement Statement, HUD-1, is used and a person is listed as the settlement agent this agent must file the Form 1099-S for the sale or exchange of real estate.
- If a HUD-1 is not used, or a person is not listed, the person responsible for closing the transaction must file the Form 1099-S for the sale or exchange of real estate.
