@Kisse1984If someone has already used your child's SSN and filed a 2023 tax return using the number, you will not be able to e-file your own tax return with the child's SSN on it; the IRS will reject the e-file. But you can claim your child on your 2023 tax return and file it by mail. The IRS will process the return and then later they will sort out who could claim the child(ren).
When you mail a tax return, you need to attach any documents showing tax withheld, such as your W-2’s or any 1099’s. Use a mailing service that will track it, such as UPS or certified mail so you will know the IRS/state received the return.
Federal and state returns must be in separate envelopes and they are mailed to different addresses. Read the mailing instructions that print with your tax return carefully so you mail them to the right addresses.
To prevent anyone from using the children's SSN's in the future you can obtain six digit PIN numbers for each child from the IRS. If you start using those 6 digit PIN's for the children, then the IRS gives each child a new PIN each year, and no one will be able to claim the child without that IP number.
