ECJ 11/1/24 C-371/22 - Electricity supply to undertakings - Early termination fee contract for a fixed period at fixed price - conditionsArticle 3(5) and (7) of Directive 2009/72/EC of the European Parliament and of the Council of 13 July 2009 concerning common rules for the internal market in electricity and repealing Directive 2003/54/ECmust be interpreted as meaning that :it does not preclude national legislation under which, in the event of early termination by a small undertaking of an electricity supply contract concluded for a fixed period and at a fixed price, with a view to changing supplier, that undertaking is required to pay the contractual penalty stipulated in that contract, the amount of which may correspond to the full price of the electricity which it had undertaken to purchase, even if that electricity has not been and will not be consumed, whereas those rules do not lay down any criterion for the calculation of such a penalty or for its possible reduction, provided that those rules, on the one hand, guarantee that such a contractual stipulation must be clear, comprehensible and freely agreed and, on the other hand, provide for the possibility of an administrative or judicial appeal, in the context of which the authority seised may assess the proportionality of that penalty in the light of all the circ*mstances of the case and, where appropriate, impose its reduction or elimination.https://lnkd.in/eZnfGB4e#powermarkets #energylaw

Interesting ruling by the Dutch court today on gas disconnections (article in Dutch). It's a pretty fundamental debate, and one where legislators and regulators across Europe should probably get on the front foot of. Should you pay to disconnect from a regulated monopoly or should that be free? And given those assets were built with a regulatory construct of guaranteed revenue for depreciation of the assets over multiple decades, who ends up paying when people start to disconnect in larger numbers (and most likely the more affluent households first...)For transparency: I disconnected last year in the UK. My supplier Octopus did the meter removal for free (but they don't have to). The pipe removal and capping (which is not mandatory but in my case required) is something you officially need to get your network company in for if you do it legally. Cost typically north of £1000... (illegally, probably half, and typically done by the same workforce on the weekend)https://lnkd.in/eYKDDUAH

📈 🌎 How does the EU-ETS maintain its incentive function?Too much supply of CO2 allowances in the market leads to a low price of allowances, which can cause emissions trading to lose its steering function. To prevent this, the Market Stability Reserve (MSR) reduces the annual auction quantities if too many allowances are in circulation. On the other hand, it can also increase the quantity of CO2 allowances to a limited extent if there are only few allowances in the market. If the quantity in circulation exceeds the upper threshold of 833 million allowances, the auction quantities will be reduced by 24 per cent of the quantity in circulation from September of the following year and transferred to the MSR. In order to permanently reduce the surpluses, the amount of allowances in the MSR is to be limited from 2023 onwards to an amount corresponding to the auction quantities of the respective previous year. Many thanks Cyril Widdershoven for sharing¡ Indeed, this behemoth, estimated to hold a staggering 2.74 trillion cubic meters of recoverable natural gas, has fueled the Netherlands for decades. However, concerns surrounding seismic activity linked to extraction and growing pressure from environmental groups ultimately led the caretaker government to prioritize public safety over economic gain.This decision will undoubtedly reshape the Dutch energy landscape. The Groningen field currently supplies a significant portion of the country's natural gas needs. Its closure necessitates the diversification of energy sources, potentially impacting energy security and pricing, especially, as you well said, during periods of global market volatility. While the economic ramifications are undeniable, the prioritization of public safety and responsible resource management reflects a shift in Dutch energy policy. Remember that facing reality, the magnitude 3.6 earthquake in Huizinge in 2012 was a turning point. Residents of Groningen have been vocal in their concerns, organizing protests and demonstrations demanding greater safety measures and eventually the closure of the field, and agencies like the KNMI (Royal Netherlands Meteorological Institute) have been monitoring the tremors in the Groningen region. Their data provided strong evidence that gas extraction was directly linked to the increase in seismic events.The coming years may see legal challenges, but the Groningen chapter serves as a turning point: energy security VS energy safety (?).#netherlands #energysecurity #gas #energytransition #seismic
