2-01:Addresses: CERTIFIED MAIL or REGISTERED MAIL: When it is Required
Certified Mail is a method of service that is required for specific parties who must be served with documents in an adversary proceeding or in a contested matter. Please read rules carefully to ascertain details beyond what is written here, as rights may be affected if service is not performed correctly.
WHICH PARTIES MUST BE SERVED BY CERTIFIED MAIL
- Institutions Insured by the FDIC: See FRBP 9014(b)andFRBP 7004(h)and for service on institutions that are insured under the Federal Deposit Insurance Corporation, in adversary proceedings or contested matters.
WHICH PARTIES MAY BE SERVED BY CERTIFIED MAIL,REGISTERED MAIL, OR FIRST CLASS MAIL
- United States or its Agencies, Corporations, Officers or Employees: See FRBP 9014(b)andFRBP 7004(b)(4)-(5) andFRCP Rule 4(i)(1)-(2) for service on the United States or its agencies, corporations, and officers or employees in their official capacity (i.e. not being sued in their individual capacity), and in adversary proceedings or contested matters.
- Attorney General of the United States: See FRBP 7004(b)(4)-(5) andFRCP Rule 4(i)(1)-(2) for service on the Attorney General of the United States in adversary proceedings or contested matters, when the Attorney General is required to be served. NOTE: In many situations, the Attorney General of the United States must ALSO be served when other parties are required to be served.
WHAT DOCUMENTS MUST BE SERVED BY CERTIFIED MAIL
- Adversary Proceedings: When a party in an adversary proceeding must be served by certified mail, this means serving the summons, complaint, and related notices required by the court.
- Contested Matters: When a party in a contested matter must be served by certified mail, this means the initial motion or objection to claim, including a motion to avoid a lien (See LBR 4003-2) or a motion to impose or continue the automatic stay [See FRBP 4001(a)(1)]. This also includes any related notice of hearing or notice of opportunity to request a hearing.
