Can you decline a service charge at a restaurant? ›

Also called operations fees, service charges are mandatory fees automatically added to restaurant bills in California. Customers cannot elect to not pay the service charge because it is part of the bill.

A service charge is a fee collected to pay for services related to the primary product or service being purchased. The charge is usually added at the time of the transaction. Many industries collect service charges, including restaurants, banking, and travel and tourism.

A discretionary service charge is added to the client's bill at the end of the service; however, the customer may refuse to pay for a variety of reasons, including dissatisfaction or laziness. A mandatory service charge is exactly that: mandatory, and as such, it must be declared upfront before the service starts.

The main difference between these two fees? A service charge is mandatory, and a tip is at the discretion of the customer. Technically, tipping is optional — but some customers might argue otherwise, given that tip income is critical for the service staff.

“Service charges typically appear on a customer's bill with a brief explanation of the purpose of the charge – i.e., to replace tipping, add to back-of-house wages, or offset expenses, depending on the circ*mstance – and the amount or percentage of the charge.

“If a restaurant charges a mandatory fee, it must be included in the displayed price,” the guidance states. “Under the law, a restaurant cannot charge an additional surcharge on top of the price listed.”

Service charges are an amount that tenants pay to cover the cost of providing communal or shared services to a building and, if applicable, the surrounding estate. The way charges are calculated and what they cover are set out in your tenancy agreement.

Credit card customers can dispute any charge that they didn't make, if it is for the wrong amount, or if they're dissatisfied with the product or service they received. Typically, the best first step is to contact the vendor.

If you're unsatisfied with the level of provision and maintenance provided, or if you believe the landlord has set the service charge at an unreasonably high level, there are ways to legally challenge it. However, aside from these routes, if you have a service charge in your contract, you should expect to pay it.

Take legal action for nonpayment of invoices

If working with collections did not work, and unpaid invoices are still lingering, it is time to seek legal action. You have the choice between small claims court or civil court. Small claims court is less time, money, and is quick to resolve your issue within the same day.

Beginning July 1, 2024, the “Honest Pricing Law” or “Hidden Fees Statute,” SB 478, makes it illegal for businesses to advertise or list a price for a good or service that does not include all required fees or charges other than certain government taxes and shipping costs.

Mandatory service charges

This is a fixed fee included on every bill that the customer is required to pay. If you don't give your diners a choice to opt out of this service charge, it's crucial to let them know upfront so they don't feel deceived when the check comes.

For example, you see service fees for purchase of online concert or movie tickets, and vacation rentals like AirBnB (3%). Service fees from software providers occur across industries from hospitality (AirBnB) to movie tickets (Fandango), concert tickets (Ticketmaster), and food delivery (UberEats).

A fee can be looked at similar to a penalty. While there are no fees attached to your contract, you can be fined for late payments or a returned payment. A charge on the other hand, is an amount that you acknowledge you are purchasing. At origination, the amount you finance is considered a charge.

How Much to Tip for Room Service. Danziger finds applying the same mentality she uses when dining at American restaurants to be helpful. "As Americans, usually we're trained to double the tax or pay 18% or 20% on top," she says. Assuming the food came from the hotel, it should be fine to do the same for room service.

In July, a new state law in California will require businesses to disclose all costs up front — a ban on so-called “junk fees” on everything from hotel rooms, to concert tickets, to restaurant food. Restaurants in particular are saying this will hurt their business.

Sometimes, restaurants will ask for collateral—like your phone or ID—to ensure your return. Some places will call law enforcement to record your information before you leave; but as long as you reappear with valid payment in a timely manner, you probably won't be charged with any wrongdoing.

Under a new California law, California restaurants will no longer be able to charge customers surcharges, or service fees. Starting July 1, Senate Bill 478, or the “Consumer Legal Remedies Act: advertisem*nts,” will ban “junk” fees on purchases made across California.
